Terms of Use

These Terms of Use govern your access to and use of elevatED. By creating an account or using the platform, you agree to be bound by these terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using elevatED (the "Platform"), you agree to these Terms of Use and our Privacy Policy. These terms form a legally binding agreement between you and SSYO (South Shore Youth Organization), the organisation that operates elevatED.

If you are under 18 years of age, your parent or legal guardian must review and agree to these terms on your behalf. By allowing a minor to use the Platform, a parent or guardian accepts these terms in full on that minor's behalf.

If you do not agree to these terms, you must not use the Platform.

2. Description of Service

elevatED is a learning management platform that provides:

  • Structured classes, lessons, and modules delivered by qualified instructors.
  • Assignment submission and graded assessments with instructor feedback.
  • Real-time progress tracking and grade reporting for students and linked parents.
  • A calendar and notification system to help students manage deadlines and upcoming events.
  • A gamification system, including points and badges, to recognise and reward consistent effort.
  • Bookable one-on-one tutoring sessions with available tutors, including video meeting support.
  • A parent/guardian observer portal providing read-only visibility into a linked student's progress.
  • Bilingual support in English and French.

The Platform is operated by SSYO and designed primarily for students enrolled in SSYO academic programmes and their families. Access requires an invitation or enrolment from an SSYO administrator or instructor.

3. Eligibility & Accounts

To use elevatED you must:

  • Be invited or enrolled by an SSYO administrator, director, or instructor.
  • Provide accurate, complete registration information (name, email, role).
  • Keep your login credentials confidential. You are responsible for all activity under your account.
  • Notify us immediately at ssyouthorg@gmail.com if you suspect unauthorised access to your account.

You may not create an account on behalf of another person without authorisation, except that a parent or guardian may assist a minor child in completing registration.

We reserve the right to refuse or revoke access to any account at our sole discretion, including for breach of these terms.

4. User Roles

elevatED uses a role-based permission system. Each role has specific capabilities and responsibilities:

Users must only use the capabilities assigned to their role. Attempting to access features or data outside your role is a violation of these terms.

5. Acceptable Use

You agree to use elevatED in a way that is respectful, honest, and consistent with the spirit of learning. Specifically, you agree to:

  • Submit original work for assessments. Academic dishonesty, including plagiarism and submitting AI-generated content without disclosure, is prohibited.
  • Treat all users — students, parents, and educators — with respect in all communications and interactions on the Platform.
  • Keep your account credentials private and not share your login with anyone else.
  • Use uploaded files and attachments only for legitimate learning purposes.
  • Report any technical issues, bugs, or concerns honestly through the appropriate contact channels.

6. Parents & Guardians

Parents and guardians who register as observers agree to:

  • Use the observer portal solely to support and monitor their own child's learning — not to access data relating to any other student.
  • Obtain their child's agreement before initiating an observer relationship where the child is 14 years of age or older.
  • Keep any information accessed through the observer portal — including grades, notes, and session details — confidential and not share it publicly.
  • Communicate with educators and platform staff respectfully and constructively.

Misuse of the observer portal, including attempting to access other students' data or harassing platform staff, will result in immediate account suspension.

7. Payments & Tutoring

7.1 Booking

Tutoring sessions can be booked by students or their parents through the Platform. Sessions are subject to tutor availability and the session cost configured by SSYO administrators.

7.2 Payment

Payment is processed securely through Stripe. You authorise us to charge the fee for the sessions selected at checkout. elevatED does not store credit card details — all payment data is handled directly by Stripe under their Privacy Policy.

7.3 Cancellations & refunds

Sessions cancelled before the platform's stated cancellation window (configured by administrators) are eligible for a full refund. Sessions cancelled after this window, or where a student does not attend without notice ("no-show"), are non-refundable.

To request a refund for an exceptional circumstance, contact us at ssyouthorg@gmail.com within 7 days of the session date.

7.4 Tutor conduct

Tutors are educators affiliated with SSYO. SSYO reserves the right to reassign a session to a different tutor at any time, with advance notice where possible. In the event of a SSYO-initiated cancellation, a full refund will be issued.

8. Content & IP

Platform content: all course materials, lessons, assessments, and resources published on elevatED are the intellectual property of SSYO and its instructors. You may not reproduce, distribute, or commercially exploit this content without written permission.

User-submitted content: when you submit an assignment, upload a file, or add a note, you retain ownership of that content. You grant SSYO a limited licence to store and display your submission solely for the purpose of facilitating your education on the Platform.

Feedback: any suggestions or feedback you provide about the Platform may be used by SSYO to improve the service without obligation or compensation to you.

9. Prohibited Uses

You must not use elevatED to:

  • Impersonate another person, including another student, parent, or educator.
  • Upload content that is illegal, abusive, harassing, defamatory, or sexually explicit.
  • Attempt to gain unauthorised access to other accounts, the database, or the server infrastructure.
  • Reverse-engineer, scrape, or copy the Platform's content or code.
  • Use automated bots or scripts to interact with the Platform.
  • Upload malware, viruses, or any file designed to damage, overload, or disrupt the Platform.
  • Share login credentials or allow others to use your account.
  • Use the Platform for any purpose unrelated to legitimate learning or administration.

Violations of this section may result in immediate account suspension and, where applicable, referral to law enforcement.

10. Termination

By you: you may request account deletion at any time by contacting ssyouthorg@gmail.com. Deletion removes your personal data subject to the retention periods described in our Privacy Policy.

By SSYO: we may suspend or terminate your account at any time, with or without notice, if we determine that you have violated these terms, if your enrolment period ends, or if the Platform is discontinued.

Upon termination, your access to the Platform and its content will cease immediately. Sections of these terms that by their nature should survive termination (including Sections 8, 11, 12, and 13) will continue to apply.

11. Disclaimers

elevatED is provided "as is" and "as available." SSYO makes no warranties, express or implied, that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

While we work hard to ensure content accuracy, SSYO does not warrant that lesson content, grades, or progress data are free from errors. Instructors are responsible for the accuracy of the content they deliver.

The Platform is not a substitute for accredited schooling, professional tutoring services, or mental health support. If you or your child is experiencing a crisis, please contact the appropriate professional service.

12. Limitation of Liability

To the fullest extent permitted by applicable law, SSYO and its directors, staff, instructors, and agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of — or inability to use — the Platform, including but not limited to:

  • Loss of data, grades, or learning records due to technical failure.
  • Interruption of access during critical assessment periods.
  • Outcomes related to a student's academic performance.

SSYO's total aggregate liability to you for any claim arising from these terms or use of the Platform will not exceed the amount you paid to SSYO in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain liabilities. In such cases, the above limitations apply only to the extent permitted by law.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the Province of Quebec, Canada and the applicable federal laws of Canada, without regard to conflict of law principles.

Any dispute arising from these terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of the Province of Quebec.

If you are located outside Canada, you acknowledge that your use of the Platform involves the transfer of data to Canada and consent to the application of Canadian and Quebec law.

14. Changes to Terms

We may update these Terms of Use from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes — such as modifications to payment terms or data use — we will notify you by email at least 14 days before the changes take effect.

Continued use of elevatED after the effective date of any update constitutes your acceptance of the revised terms. If you do not agree to the changes, you must stop using the Platform and may request account deletion.
